– Ethics and the Virtuous Mediator-Lawyer
An interactive
exploration of the perplexing relationship between the rules of
ethics and malpractice standards featuring an examination of
duties under Common Law and the Rules, how to avoid breaches of
these duties, useful tools of analysis and prevention and common
pitfalls, with interactive hypotheticals. IAn interactive seminar
that examines many of the most challenging ethical issues in real
world practice, as well as the multiple ethical systems that
influence how attorneys-mediators respond to them. Challenging and
often humorous hypotheticals will present scenarios involving such
issues as conflicts, confidentiality, billing issues, client
management, technology, negotiation practices and more
.The codes and rules
governing professional conduct for attorneys provide little
guidance for attorneys serving as mediators. Attorneys must
instead rely on their own understanding of the principles of
mediation and the applicable ethical standards. This course
discusses those principles and standards, and provides a framework
for resolving ethical dilemmas that arise in mediation.
